Judgement of the Court, Commission/Italy, Case 101/84 (11 July 1985)

In its judgment of 11 July, in case 101/84, Commission v Italy, the Court of Justice declares that although it is true that a bomb attack on the data processing centre of the Italian Ministry for Transport, which took place before 18 January 1979, may have constituted a case of force majeure and created insurmountable difficulties, its effect could only have lasted a certain time, namely the time which would in fact be necessary for an administration showing a normal degree of diligence to replace the equipment destroyed and to collect and prepare the data. The Italian Government cannot therefore rely on that event to justify its continuing failure to comply with its obligations years later.
