Judgement of the Court in Case 16/88, Commission of the European Communities v Council of the European Communities. The Court considers whether the Council, by making the adoption of decisions which it empowers the Commission to take subject to the ‘management committee’ procedure, has encroached upon the Commission’s power to implement the budget on its own responsibility.
